Orgill Exclusive Brand Products

This Limited Warranty applies to select Orgill Exclusive Brand Products, including ProSource®, Vulcan®, Landscapers Select®, PowerZone®, Boston Harbor®, Simple Spaces®, Omaha®, and Diamondback® branded items (collectively, “Orgill Products”). This warranty is offered by Orgill, Inc. (“Orgill”) to the original consumer purchaser.

I. General Terms

Orgill expressly warrants that its products are free from defects in materials and workmanship under normal use and service for the applicable warranty period stated below, beginning on the original date of purchase. This Limited Warranty is non-transferable and applies only to the original purchaser who bought the product from an authorized Orgill retailer or distributor. This Limited Warranty only applies to products which are used, stored, handled, and installed in the manner recommended by Orgill.

This warranty does not cover:

• Normal wear and tear
• Damage due to misuse, abuse, neglect, alteration, improper installation, improper maintenance, or accident
• Use in commercial or industrial settings (unless product is specifically rated for
• such use)
• Cosmetic damage or deterioration of appearance
• Acts of nature (e.g., flooding, fire, or other force majeure events)

II. Remedies

The sole remedy under this warranty is repair or replacement, at Orgill’s discretion, if the Product fails or does not perform as warranted solely due to a manufacturing defect within the warranty period, subject to any exclusions set forth in this Limited Warranty. Orgill’s obligation as to repair or replacement shall further be limited to repair or replacement with the styles, models, products, colors, etc. of the product that are available at the time of the repair or replacement. In no event shall Orgill be liable for incidental, indirect, or consequential damages.

III. Warranty Periods by Product Category

Unless otherwise stated on product packaging or the Orgill website, Orgill products are covered by one of the following Limited Warranties:

A. Limited Lifetime Warranty: Covers defects in materials and workmanship for the useful life of the product. "Useful life" means the period during which the product is capable of being used as intended under normal conditions and proper maintenance.

B. Limited 25-Year Warranty: Covers defects for 25 years from the date of purchase.

C. Limited 10-Year Warranty: Covers defects for 10 years from the date of purchase.

D. Limited 5-Year Warranty: Covers defects for 5 years from the date of purchase.

E. Limited 1-Year Warranty: Covers defects for 1 year from the date of purchase.

IV. Making a Warranty Claim

To file a warranty claim:

1. Contact the original retailer or place of purchase where the product was bought.
2. Provide valid proof of purchase (receipt, order confirmation, or other documentation).
3. The retailer will evaluate the product and, if the claim is approved, issue a replacement or refund.

Orgill does not process warranty claims directly. All claims must be submitted to the

original retailer. Shipping or transportation costs may be the responsibility of the

purchaser.

V. Legal Rights

This Limited Warranty gives you specific legal rights. You may also have other rights that vary from state to state.

TO THE EXTENT PERMITTED BY LAW, ALL IMPLIED WARRANTIES (INCLUDING BUT NOT LIMITED TO MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE) ARE LIMITED TO THE DURATION OF THE APPLICABLE EXPRESS WARRANTY STATED ABOVE.
